Veterans with service-connected disabilities that occurred because of injury or disease that happened in or was aggravated by active duty, active duty for training, or inactive duty training, may qualify for disability compensation. The VA awards benefits based on severity that range from 0 to 100 percent disability. Veterans who receive a service-connected disability rating of 30 percent or more may qualify for additional allowances for dependents.
Means of establishing service-connected disabilities include:
- Injury or disease related to active service
- Aggravated a pre-existing injury or disease during active service
- A disability resulted in a secondary disability, related to active service
Only veterans with a general or honorable discharge qualify for VA disability compensation. If you have a dishonorable discharge, you may qualify for a discharge upgrade. See Record Corrections.
Rating Decision Overview
After you submit your claim to the VA, you will receive a VA rating decision. The VA rating decision will accept your entire claim, accept part of your claim, or deny your claim.
If the VA accepted your entire claim, you should make sure the VA correctly determined your claim rating and your effective date. For VA disability claims, your effective date starts your date of separation if you filed within one year of separating. If you filed later than one year, your effective date starts the day you filed your claim.
If the VA denied any part of your claim, you can file a notice of disagreement within one year of receiving your rating decision. Swift & McDonald stands ready to take on your claim and help you with this confusing process.
